The Constitution of Kenya 2010 was promulgated on the 27th August 2010 following a process set out in the 2008 Constitution of Kenya Review Act. The Constitution of Kenya 2010 acts as a guide to various aspects of Water and Sanitation which are captured in several sections including;

1. Chapter Two, The Republic, Devolution and access to services

2. Chapter Four, The Bill of Rights, Part 1—General provisions relating to the Bill of Rights’

3. Economic and social rights. Part 3 – Specific application of rights, Minorities and marginalized groups

4. Chapter Five, Land and Environment,

5. Chapter Twelve, Part 1 – Principles and framework of public finance Equalization Fund

6. Fourth Schedule, Distribution of functions between the National and Country governments.

The Constitution of Kenya 2010 is the supreme law of the Republic and therefore all other laws and regulations must be consistent with this constitution.

WSP Af was selected to be a member of the committee to oversee the harmonization exercise. The committee has now selected the following 6 key areas for review;
1. Bill of rights

2. Institutional Framework

3. Financing Mechanisms

4. Rural Water Supply

5. Legal Consistency of amendment proposals

6. Quality Assurance of proposed amendments
